The text and data mining exception is key to AI-driven progress for Europe
In this paper for Google, Brian Williamson concludes that Europe should maintain the text and data mining (TDM) framework introduced in 2019 which provides clarity for AI model development.
There is a trade-off involved with calls for stricter controls on the use of existing knowledge for model training - either models trained elsewhere would be relied upon or the supply of AI would be restricted - harming competitiveness and the whole economy. Reopening TDM would - at the very least - result in a harmful period of uncertainty at a critical time in terms of the development and use of AI. Uncertainty over the EU TDM framework may also increase the likelihood of national policy initiatives that unravel a single EU market approach.
